Defer Capital Gains Tax

In order to execute an exchange, you must take the money you gain from the sale of an initial (relinquished) property and put it into a trust while you look for a replacement property or properties.

The replacement properties must be identified to the IRS within 45 days of closing on the relinquished property. You have 180 days from the original closing to complete the exchange. If time constraints or other qualifications aren't met, the money in the trust then becomes subject to the appropriate capital gains tax.
